Kansas initial registration packet guide

Kansas charitable solicitation registration

Kansas initial charity registration is a complete paper filing packet delivered before covered solicitation begins. The organization should confirm its exemption position, reconcile the legal and financial record, exclude Schedule B from the Form 990 copy, obtain two authorized officer signatures including the chief fiscal officer, submit the $25 fee, and verify the mailed certificate and public directory.

Scope note: This page covers Kansas initial charitable organization registration. Annual renewal, expired-registration recovery, professional fundraiser or solicitor filings, nonprofit corporation records, federal returns, and another state’s requirements are separate. This guide is informational and not legal or tax advice.

Resolve the Kansas trigger before building the packet

List the organization’s Kansas fundraising activity: donation pages, targeted email and mail, events, grants, peer-to-peer campaigns, fundraising vendors, and solicitation names. Kansas requires covered charitable organizations to register with the Attorney General before soliciting. A nonprofit corporation record or IRS determination letter is not the charitable solicitation certificate.

Review K.S.A. 17-1762 for the statutory exemptions and preserve the facts supporting the organization’s position. The Attorney General says it cannot grant an exemption or advise whether one applies. If a professional fundraiser or solicitor is involved, route that person or company through its separate registration and reporting process rather than assuming the charity packet covers everyone.

Prepare one reconciled organization record

Complete the current registration statement using the legal name, solicitation names, address, purpose, responsible officers and directors, fiscal year, contribution activity, fundraising relationships, and financial information. Reconcile the entries to the organizing documents, IRS record, board-approved people, accounting records, and campaign copy before anyone signs.

Kansas requires two separate authorized officer signatures, including the chief fiscal officer. Coordinate the wet signatures without circulating multiple uncontrolled versions. Keep the final signed form, approval history, and payment authorization together so the submitted identity, financial period, and certifications remain consistent.

Attach the correct financial record and exclude Schedule B

The current packet checklist calls for Form 990 without Schedule B or the Attorney General financial statement. Include an audited financial statement when the current form’s contribution-and-grant threshold applies. Confirm the fiscal period on every attachment and reconcile revenue, contributions, grants, expenses, assets, and signatures to the approved books.

Do not include Schedule B with the Form 990 copy. Removing the donor schedule is an explicit filing instruction, not an invitation to remove other required information. If the organization did not file the federal return or the return is not ready, use the Attorney General financial statement route that matches the instructions rather than delaying the state decision without a plan.

Submit the complete $25 packet and control delivery

Include the completed statement, $25 check or money order, required financial record, and any audit that applies. Use the current Attorney General address and payment instructions. Before mailing, scan the signed packet and payment record, then preserve trackable delivery evidence. A partial packet can delay acceptance and compress the campaign calendar.

Route agency correspondence to a monitored owner and answer any deficiency from the reconciled source record. Do not mail a second application simply because the public directory has not updated. Confirm the status of the first packet and follow the record-specific instructions supplied by the Registration Unit.

Verify the certificate and install the annual control

Kansas says it processes complete packets and mails a certificate of registration. Save that certificate and verify the organization appears in the Attorney General registration directory. Registration is not a state endorsement, and the certificate should not be described as approval of the charity’s programs, governance, or fundraising quality.

Record the fiscal year and calculate the next expiration as the last day of the sixth month after fiscal year end. Kansas does not extend that deadline for an IRS extension. Start the next financial statement and officer-signature process early enough for the complete renewal packet to arrive before expiration.
